Requiring CAR / PRDS Forms
This preference typically stems from the listing agent's comfort with the language or information provided by the forms publisher.
While agents can indicate their preference for certain forms in their remarks, they should not demand their use unless they have written instructions, signed by the client, explicitly stating that offers must be submitted on those specific forms. Without such instructions, the agent may be withholding offers from the client without their consent, which is a clear ethical violation according to the state’s Professional Standards attorney.
Acceptable language to use could be "Please use CAR forms" or "PRDS forms preferred." In this way, agents can express their preference but do not go so far as to require a specific format.
To ensure a successful experience for all parties involved, it is crucial to maintain open communication and work cooperatively on all aspects of the transaction.
