MLS Rules Update – 2 Changes
The requirement to add a photo to a listing has been changed from 3 days to one day
This change improves the value of the service for brokers, agents and consumers by increasing the
timeliness and speed of important property information.
This change was also made by our neighboring MLSs to normalize our practices across the markets.
The rule is effective now but will be enforced beginning March 1, 2020.
Effective January 1, 2020, the California Consumer Privacy Act (“CCPA”) went into effect
MLSListings has adopted a C.A.R. model rules new section recommendation, with language to support the CCPA.
The new Section 11.10 (Data Privacy) acknowledges MLS participants have advised their clients as to what their privacy rights are with respect to the new law. That they have given lawfully required privacy notices and opt-out rights to respective seller and buyer clients whose personal information may be submitted or included in the MLS. For REALTORS®, new C.A.R. standard form CCPA is bundled with disclosures for this purpose. Other forms could also comply.
The MLS Rule would make submitting a copy of adequate notice a requirement when asked by the MLS, and the failure to provide documentation would be a rule violation.
