Advertising or Promoting Listings of Other Brokers (or their Agents)

The MLSListings rules explicitly address the advertising of listings from other brokers, which applies to the various forms of media, including but not limited to; video & audio recordings, emails, printed flyers or cards, window displays or other promotional forms.

Specifically, Rule 12.8 of the MLS states:
12.8 Advertising of Listing Filed With the MLS

A listing shall not be advertised by any participant or subscriber, other than the listing broker, without the prior consent of the listing broker except as provided in Sections 12.16 and 12.20 relating to display of listings on the internet.

Therefore, if you wish to advertise or promote a property on your social media accounts or any other means that is listed on the MLS, you must obtain permission from the listing broker or their agent, before posting or advertising the listing. It is crucial to comply with this rule to avoid any potential violations.

Is it necessary for permission to be in written form?
Like any other instructions or directions provided to real estate agents representing someone else, it is generally advisable for such permissions to be documented in writing or in a format that can be produced as evidence if needed. Best practices suggest that having a written record can help clarify the terms and conditions of the permission and protect all parties involved in case of any disputes or challenges

The MLS Compliance team diligently upholds and enforces this rule on behalf of the real estate community, ensuring that participants and subscribers adhere to the regulations regarding the advertising of listings from other brokers.
Understanding and adhering to these rules helps maintain the integrity and professionalism of the industry.
